LOCUS MULTI-PURPOSE MONEY REMITTANCE SERVICES ("Multi- Services") ARE PROVIDED SUBJECT TO THESE TERMS AND CONDITIONS ("AGREEMENT") AND APPLICABLE LAW. Service availability depends on certain transaction conditions including the service selected, amount sent, destination country, currency availability, regulatory issues, identificacion requirements and location hours.

The Sender must provide Locus and or its Agents with valid government issued picture identification and a copy of the form of payment used before a transaction will be released. Locus has the discretion to request additional documentation to verify the sender’s identity, and to disapprove a transaction if it cannot satisfactorily verify sender’s identity and payment information. Sender represents, warrants and certifies to Locus that its and their use of the Services shall not in any way, directly or indirectly, (a) violate any law, statute, ordinance, contract or regulation, including but not limited to any law, statute, ordinance, contract or regulation relating to money laundering, illegal gambling activities, support for terrorist activities, fraud or theft, and/or (b) violate any of the Terms of Use. Locus may, at its discretion, freeze any transaction that appears to be suspicious and withhold related funds until Locus determines the transaction to be legitimate. When required by applicable law, money transfers will be reported to federal, state, local or foreign authorities. In addition, Locus will cooperate with law enforcement in the prosecution of illegal activities to the fullest extent permitted by applicable law. To help the government fight the funding of terrorism and money laundering activities, Federal law requires financial institutions and their third parties to obtain, verify, and record information to identify you. You will be asked for your name, address, date of birth, and other information that will allow us to identify you.

IF YOU PROVIDE FALSE INFORMATION, YOUR ABILITY TO USE THE SERVICE MAY BE TERMINATED AND ANY PENDING MONEY TRANSFERS MAY BE CANCELLED. IN ADDITION, YOU MAY BE SUBJECT TO CIVIL AND CRIMINAL PENALTIES.

FEES, PAYMENT, AND CURRENCY EXCHANGE RATE:
Locus may or may not make additional profits from the currency exchange rate based on individual agreements with its various delivering agents. Locus does earn, in consideration for its services, the transaction fee in effect at the time the transaction is entered. The applicable transaction fee will be provided to you prior to your final authorization of the transaction.

RESOLUTION OF DISPUTES:
The parties acknowledge that, except as expressly provided in this section, they are waiving all rights to a trial by court or jury as a means of resolving any disputes arising out of or relating to their use of Locus Multi-Purpose Money Remittance Services Either You or Locus can require that any controversy or dispute arising out of the Services or these Terms be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (available at http://www.adr.org) and, as the parties acknowledge and agree that this arbitration agreement is made pursuant to a transaction involving interstate commerce, it shall be governed by the Federal Arbitration Act, as incorporated in Title 9 of the United States Code. Arbitration replaces the right to go to court, including the right to a jury and the right to participate in a class action or similar proceeding. In arbitration, a dispute is resolved by a neutral arbitrator instead of a judge or jury. Arbitration procedures are simpler and more limited than rules applicable in court. The decision of the arbitrator is final and binding.

The arbitrator shall issue a reasoned award if so requested by You or Locus, and may not modify, rewrite, or otherwise reform these Terms, including but not limited to interpreting the Terms beyond the range of semantic permissibility. The arbitrator, in his or her discretion, shall have the right to award reasonable costs and attorneys' fees to the prevailing party. These Terms shall be governed according to the laws of the State of New Jersey. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to Use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Disputes include not only claims made directly by You, but also made by anyone connected with You or claiming through You, such as a Beneficiary. Disputes include not only claims that relate directly to Locus, but also its successors, assignees, employees, and agents, and claims for which Locus may be directly or indirectly liable, even if it is not properly named at the time the claim is made. Disputes include claims based on any theory of law, contract, statute, regulation, tort (including fraud or any intentional tort), or any other legal or equitable ground, and include claims asserted as counterclaims, cross-claims, third-party claims, or otherwise. Disputes include claims made as part of a class action or other representative action, it being expressly understood and agreed to that the arbitration of such claims must proceed on an individual (non-class, non-representative) basis. Disputes also include claims relating to the enforceability or interpretation of any of these arbitration provisions.

LIMITATION OF LIABILITY:
Except for your right to a refund, Locus will not be liable for damages caused by delay, non-delivery, nonpayment or underpayment of any money transfer, or any supplemental message, whether caused by negligence on the part of its employees, suppliers or agents or otherwise. In no event will Locus be liable for any indirect, special, incidental, consequential exemplary or punitive damages, or the like. These conditions cannot be changes or supplemented orally. Locus reserves the right to limit the principal amount of a money transfer, or to reject a proposed money transfer, in its sole discretion. Locus assumes no obligation to make payment of the money transfer or to complete the applicable money transfer transaction if Locus does not receive authorization from the bank card issuer or depository institution, nor does Locus assume any liability for damages resulting from nonpayment of the money transfer or any failure to complete any applicable Service transaction by reason of such lack of authorization. Locus reserves the right to refuse to provide the Services to You, at any time, for any reason deemed necessary to protect Our interests.

Locus shall not be liable for any interruption of service due to causes beyond its control, including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the money remittance; acts of God; acts of public authorities acting with actual or apparent authority; insufficient information provided by a customer; the application of security regulations imposed by the government, or otherwise applicable to the delivery location; riots, strikes, or other labor disputes; civil commotions; disruptions in ground transportation networks, such as weather phenomena; and natural disasters.

DISCLAIMER OF WARRANTIES:
You expressly understand and agree that (a) Locus expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement; (b) Locus makes no warranty that (i) the service will meet Your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the Use of the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other material obtained by You through the Service will meet Your expectations, and (v) any errors in the software will be corrected; (c) any material downloaded or otherwise obtained through the Use of the Service is done at Your own discretion and risk and that You will be solely responsible for any damage to Your computer system or loss of data that results from the download of any such material; and (d) no advice or information, whether oral or written, obtained by You from Locus or through or from the Service shall create any warranty not expressly stated in these Terms.

INDEMNITY:
You agree to indemnify, defend and hold Locus, and all its officers, directors, owners, agents, employees, affiliates, licensors, licensees and third party service providers (collectively, the "Indemnified Parties") harmless from and against any and all losses, damages, liabilities, and claims and all fees, costs, expenses of any kind related thereto (including, without limitation, reasonable attorneys fees) incurred by the Indemnified Parties in connection with any claim arising out of, based upon or resulting from (i) Your access to and/or Use of the Locus Multi-Purpose Money Remittance Services and (ii) the violation of the Terms outlined herein.

GENERAL INFORMATION:
This Agreement, together with all items incorporated by reference, embodies the entire understanding among the parties. It supersedes all prior understandings and cannot be modified orally. Locus has the right to assign this Agreement to any party, at any time without Your consent. This Agreement is governed by New Jersey law without regard to conflicts of law rules. If an Agreement provision is found invalid, remaining provisions shall be valid. Services are directed solely to persons 18 and over. The English language version controls if there is an inconsistency between English and non-English Agreement versions. You and Receiver represent that your use of Services does not violate: (a) any law, including, without limit, laws relating to money laundering, illegal gambling activities, support for terrorist activities or fraud; and/or (b) this Agreement. Information provided to Locus and or its Agents shall be truthful and complete. You shall indemnify Locus and its Agents for all losses of any kind (including attorney fees) arising out of any Agreement breach by You or the Receiver. Locus reserves the right to change Services without notice. Locus and its Agents may refuse to provide Services to any person. Locus does not guarantee delivery or suitability of goods or services paid for with Services.

Terminos y Condiciones
Los Servicios de Remesas “LOCUS MULTI-PURPOSE MONEY REMITTANCE SERVICES (“Multi-Servicios”) SON PROPORCIONADOS SUJETOS A ESTOS TERMINOS Y CONDICIONES (“CONTRATO”) Y LEYES APLICABLES. La disponibilidad del servicio depende de las condiciones de ciertas transacciones incluyendo el servicio seleccionado, cantidad enviada, pais de destino, disponibilidad de la moneda, asuntos regulatorios, requisitos de identificacion y horas laborables.

El remitente debe proveer a Locus y/o sus Agentes una identification valida proveida por el gobierno y una copia de la forma de pago utilizada para antes de que la transaccion sea liberada. Locus tiene la discrecion de requerir documentacion adicional para verificar la identidad del emisor, y a desaprovar una transaccion si esta no puede verificar satisfactoriamente la identidad e informacion de pago. El Emisor representa, garantiza y certifica a Locus que su uso del servicio no sera de ninguna manera, directa o indirectamente, (a) violar ninguna ley, estatuto, ordenanza, contracto o regulacion relacionada al lavado de dinero, actividades ilegales de apuestas, apoyo a actividades terroristas, fraude o robo, y/o (b) violar alguno de los Terminos de Uso. Locus puede, a su discrecion, congelar cualquier transaccion que parezca ser sospechosa y retener fundos relacionados hasta que Locus determine que la transaccion es legitima. Cuando se requiera por leyes aplicadas, la transferencia de dinero sera reportada a las autoridades federales, estatates, locales o extranjeras. Ademas Locus cooperara con la aplicacion de la ley en el enjuciamiento de las actividades ilegales hasta donde sea permitido por la ley applicable. Para ayudar al gobierno a luchar contra la financiacion del terrorismo y las actividades del lavado de dinero, La ley Federal require que las instituciones financieras y sus afiliados obtengan, verifiquen y colecten informacion para identificarlo a usted. A usted se la pedira su nombre, direccion, fecha de nacimiento y otras informaciones que nos permitiran identificarlo. SI PROPORCIONA INFORMACION FALSA, SU ABILIDAD PARA USAR EL SERVICIO SERA TERMINADA Y CUALQUIER TRANSFERENCIA PENDIENTE PUEDE SER CANCELADA. ADEMAS, USTED PUEDE ESTAR SUJETO A SANCIONES CIVILES Y PENALES.

CARGOS, PAGOS Y TARIFAS PARA EL CAMBIO DE LA MONEDA:
Locus puede o no obtener ganancias con las tarifas de cambio de la moneda, basado en acuerdos individuales con sus diversos agentes de entregas. Locus gana, en consideracion por sus servicios, el cargo por transaccion en efecto al momento que la transaccion es entrada. El cargo aplicado por la transaccion le sera proveido antes de su autorizacion de la transaccion final.

RESOLUCION DE DISPUTAS:
Las partes reconocen que, excepto como esta expresamente proveido en esta seccion, se renuncia a todos los derechos a un juicio por el tribunal o jurado como medio para resolver cualquier disputa originada fuera de o en relacion con el uso de Servicios de remesas Locus Multi-Uso (Locus Multi-Purpose Money Remittance Services).

Ni Usted ni Locus pueden requerir que ninguna controversia o disputa originada por estos servicios o estos Terminos se resuelva mediante arbitraje de acuerdo con las reglas de arbitraje commercial de la Asociacion Americana de arbitraje (disponible en http://www.adr.org) y, como las partes reconocen y acuerdan que este contrato de arbitraje esta hecho en virtud a una transaccion de comercio interestatal se regira por la Ley Federal de Arbritraje, incorporado en el Titulo 9 del código de los Estados Unidos. Arbitraje reemplaza el derecho de acudir a los tribunales, incluyendo el derecho a un jurado y el derecho a participar en una accion de clase o procedimiento similar. En el arbitraje, se resuelve una disputa por un arbitro neutral en lugar de un juez o un jurado. Procedimientos de arbitraje son mas simples y mas limitados que las normas aplicables en los tribunales. La decision del arbitro es definitiva y vinculante.

El árbitro deberá emitir un premio razonable si así lo solicita Usted o Locus y no puede modificar, reescribir o por el contrario reformar estos Términos, incluyendo pero no limitado a la interpretación de los términos de uso más allá del rango de licitud semántico. El árbitro, a su discreción, tendrá el derecho para otorgar los gastos razonables y honorarios de abogados a la parte prevaleciente. Estos Términos se regirán de acuerdo a las leyes del Estado de Nueva Jersey. Usted acepta que independientemente de cualquier estatuto o ley en contrario, cualquier reclamación o causa de acción resultante de o relacionados con el uso del servicio o estos términos deben presentarse en el plazo de un (1) año después que dicha reclamación o causa de acción surgió o sera para siempre descalificada. Disputas incluyen no solo reclamaciones hechas directamente por usted, pero también realizadas por cualquier persona relacionada con usted o reclamar a través de usted, tales como un beneficiario.

Disputas incluyen no sólo las reclamaciones que se refieren directamente a Locus, pero también sus sucesores, cesionarios, empleados, agentes y reclamos por los cuales Locus puede ser directamente o indirectamente responsable, incluso si aún no es correctamente llamado al tiempo de la reclamación. Disputas incluyen reclamaciones basadas en cualquier teoría de la ley, contrato, estatuto, Reglamento, agravio (incluyendo fraude o cualquier agravio intencional) o cualquier otro motivo legal o equitativo e incluyen reclamaciones declaradas como contrademandas, reclamaciones cruzadas, las reclamaciones de terceros, o de otro tipo. Disputas incluyen alegaciones como parte de una acción de clase o de otra acción representativa, que expresamente se entendió y se convino en que el arbitraje de reclamaciones de ese tipo debe proceder sobre una base individual (no de clase, no representante). Controversias también incluyen reclamaciones relativas a la aplicabilidad o interpretación de cualquiera de estas disposiciones de arbitraje.

LIMITACIÓN DE RESPONSABILIDAD:
Excepto por su derecho a un reembolso, Locus no será responsable de los daños causados por la demora, no entrega, no pago o pago insuficiente de cualquier transferencia de dinero, o cualquier mensaje suplementario, causado por la negligencia por parte de sus empleados, proveedores o agentes u otros. En ningún caso Locus será responsable de cualquier daño indirecto, especial, incidental, consecuencial ejemplar o punitivo o similar. Estas condiciones no pueden ser cambiadas o complementadas oralmente. Locus se reserva el derecho de limitar la cantidad principal de una transferencia de dinero, o rechazar una transferencia de dinero propuesta, a su entera discreción. Locus no asume obligación alguna para el pago de la transferencia de dinero o para completar la transacción de transferencia de dinero aplicables si Locus no recibe autorización del emisor de la tarjeta de banco o institución de depósito, ni Locus asume cualquier responsabilidad por daños resultantes del no pago de la transferencia de dinero o cualquier falla para completar cualquier transacción de servicio aplicable por esa falta de autorización. Locus se reserva el derecho a negarse a proporcionar los servicios a Usted, en cualquier momento, por cualquier razón que considere necesaria para proteger nuestros intereses.

Locus no será responsable por cualquier interrupción del servicio debido a causas que escapen a su control, incluyendo, pero sin limitarse a, los siguientes: la falta de disponibilidad o el rechazo de una persona a aceptar la entrega de la remesa de dinero; actos de Dios; actos de las autoridades públicas con autoridad real o aparente; insuficiente información proporcionada por el cliente; la aplicación de normas de seguridad impuestas por el Gobierno, o de lo contrario aplicables a la ubicación de entrega; motines, huelgas o otros conflictos laborales; conmociones civiles; interrupciones en las redes de transportes terrestre, tales como fenómenos del clima y los desastres naturales.

EXENCION DE RESPONSABILIDAD DE GARANTIAS:
USTED, expresamente entiende y acepta que (a) Locus rechaza expresamente todas las garantías de algun tipo, ya sea expresa o implícita, incluyendo, pero sin limitarse a, las garantías implícitas de COMERCIABILIDAD, idoneidad para un propósito particular y de no infracción; (b) Locus no garantiza que (i) el servicio cumplirá con sus requisitos, (ii) el servicio será ininterrumpido, oportuno, seguro, o libre de errores, (iii) los resultados que pueden obtenerse de la utilización del servicio serán exactos o confiables, (iv) la calidad de los productos, servicios, información u otro material obtenido por usted a través del servicio satisfaga sus expectativas y (v) cualquier error en el programa de computadoras será corregidos; (c) cualquier material descargado u obtenido de otro modo mediante el uso del servicio se realiza a su propia discreción y riesgo y usted será exclusivamente responsable de cualquier daño a su sistema informático o pérdida de datos resultante de la descarga de dicho material; y (d) ningún Consejo o información, ya sea oral o escrita, obtenida por usted de Locus o a través o desde el servicio creará ninguna garantía no expresamente especificada en estos términos.

INDEMNIZACIÓN:
Usted acepta indemnizar, defender y eximir de responsabilidad a Locus , y todos sus oficiales, directores, propietarios, agentes, empleados, afiliados, licenciantes, licenciatarios y terceros proveedores de servicios (colectivamente, las "partes indemnizadas") de y contra cualquier y todas las pérdidas, daños y perjuicios, reclamaciones y todos honorarios, costos, gastos de cualquier tipo (incluyendo, sin limitación, honorarios de abogados razonables) incurridos por las partes indemnizadas en relación con cualquier reclamación que surja de, basado en o resultantes de (i) el acceso a y/o el uso de la remesas de dinero de Servicios Multi-Uso Locus y (ii) la violación de los Términos descritos en el presente documento .

INFORMACION GENERAL:
Este acuerdo, junto con todos los elementos incorporados por referencia, encarna el acuerdo completo entre las partes. Se sustituye todos los acuerdos anteriores y no puede modificarse de forma oral. Locus tiene derecho a asignar este acuerdo a cualquiera de las partes, en cualquier momento y sin su consentimiento. Este contrato se rige por la Ley de Nueva Jersey sin relación con conflictos de leyes. Si una disposición del acuerdo se encuentra no válida, restantes disposiciones serán válidas. Servicios están dirigidos exclusivamente a personas de 18 años y más. La version del idioma Inglés controla si existe una incoherencia entre el Inglés y las versiones no en Inglés del contrato. Usted y el receptor garantizan que su uso de servicios no violan: (a) cualquier derecho, incluyendo, sin limitación, las leyes relacionadas con el lavado de dinero, las actividades ilegales de juegos de azar, apoyo a las actividades terroristas o fraude; o (b) el presente acuerdo. La información proporcionada a Locus y/o sus agentes deberá ser veraz y completa. Usted deberá indemnizar a Locus y sus agentes por todas las pérdidas de cualquier tipo (incluidos los honorarios de los abogados) derivadas de cualquier incumplimiento de contrato por usted o el receptor. Locus reserva el derecho de cambiar los Servicios sin previo aviso. Locus y sus agentes podrán negarse a prestar Servicios a cualquier persona. Locus no garantiza la entrega o la idoneidad de los bienes o servicios pagados con estos Servicios.
