Overview
This Settlement resolves a lawsuit over whether Locus Telecommunications, Inc., (referred to as “Locus”) adequately informed consumers about the applicable rates and charges for its prepaid and rechargeable calling cards. The parties disagree on whether Locus did anything wrong. Locus denies the claims and charges raised in the lawsuit, as well as any wrongdoing in its sale, distribution or marketing of its pre-paid calling cards. In settling this action, Locus agreed to provide Refund PINs worth up to $3,663,520 to eligible customers of Locus Calling Cards. Locus also has agreed to make $300,000 in charitable contributions, and to provide prospective discounts on future sales of Locus Calling Cards totaling $200,000. Pursuant to the terms of the Settlement, Locus will provide free calls to domestic locations and certain international locations to Class Members if they (1) submit a Personal Identification Number (“PIN”) from a Locus Calling Card that they purchased between January 1, 1997 and November 13, 2008; or (2) submit a notarized statement confirming that they purchased a Locus Calling Card between January 1, 1997 and November 13, 2008. If you are eligible, you may claim these benefits, as provided for in the Settlement, or you may have excluded yourself from the Settlement or objected.
 

Claims Submission Period
All claims under this Settlement must be made during the six-month Claims Submission Period which begins on April 16, 2009. A list of Locus Calling Cards is available on this website.

Exclusions and Objections
The deadline to exclude yourself from the Settlement or object to or comment in support of the Settlement was February 12, 2009.

Fairness and Hearing
The Court held a Fairness Hearing on March 12, 2009 in Judge Peter G. Sheridan’s courtroom in the Martin Luther King Federal Building and U.S. Courthouse located at 50 Walnut Street, Room 2037, Newark, New Jersey, and determined that the Settlement should be approved as fair, adequate, and reasonable.
